Evolution Golf Cart Lawsuit: Tariffs, CBP Probe, CARB Settlement

The Evolution golf cart lawsuit picture is not one case but several overlapping legal problems: a California consumer breach-of-contract suit, a federal customs investigation into suspected duty evasion, antidumping and countervailing tariffs above 350% on the company’s Chinese-made vehicles, and a $550,000 emissions settlement with California regulators. Together they raise real questions for anyone who owns an Evolution cart or is thinking about buying one.

Evolution Electric Vehicles, based in Corona, California, rebranded from HDK Electric Vehicles in 2016 and sells electric golf carts and low-speed vehicles built in China.¹ That manufacturing footprint is at the center of most of the company’s current legal exposure.

The Consumer Lawsuit and What Buyers Are Complaining About

In June 2025, two California consumers, Gina Souza and Bill Wishart, sued Evolution in Santa Clara County Superior Court for breach of contract. They alleged they had purchased an Evolution Forester 6 PLUS electric cart and that the company failed to honor its contractual obligations.²

That case fits a pattern visible in Evolution’s Better Business Bureau file, where the company is not accredited. The BBB profile shows 26 complaints filed in the last three years, 15 of them closed in the most recent 12 months. Twenty of the 26 complaints concern service or repair issues. Seventeen went unanswered by the company, three remain unresolved, and only one was marked fully resolved.³

The complaints themselves are consistent. Owners report lithium batteries that will not hold a charge, suffer complete power loss, or need repeated rebuilds. Several describe safety-critical failures, including carts shutting down or stopping abruptly in motion and throwing passengers forward. One owner reported a burnt rubber smell and a melted motor controller terminal housing. Others cite manufacturing defects out of the box: misaligned steering columns, scratches, and carts that randomly speed up or slow down.³

Warranty handling is a recurring flashpoint. Customers say Evolution is slow to respond, refuses to speak directly with them, takes months to ship replacement parts, and in some cases replaces failed batteries with rebuilt units rather than new ones. Evolution has pushed back. The company said battery issues are “among the most complex” to diagnose and that “all of our operations remain fully active,” characterizing reports of parts unavailability as “online rumors” spread by competitors.³ Evolution’s own recall page lists no active recalls on its vehicles.⁴

Tariffs of More Than 350% on Evolution’s Chinese Supplier

The larger threat to Evolution’s U.S. business comes from trade enforcement. In June 2024, the American Personal Transportation Vehicle Manufacturers Coalition, made up of Club Car and Textron Specialized Vehicles (the maker of E-Z-GO and Cushman), petitioned the U.S. Department of Commerce and the International Trade Commission to impose duties on Chinese-made low-speed personal transportation vehicles.⁵ Formal antidumping and countervailing duty orders took effect in August 2025 and will stay in place for at least five years.⁶

At least one industry source identifies Evolution’s Chinese supplier as Xiamen Dalle / HDK, one of the mandatory respondents in the Commerce investigation.⁷ Xiamen Dalle received some of the harshest rates in the case:

Combined, the two duties exceed 350% of declared import value. Commerce and the ITC also found “critical circumstances,” which lets the duties apply retroactively to entries made up to 90 days before the preliminary determinations; for countervailing duties, the retroactive reach extends to entries on or after September 7, 2024.⁶

The CBP Duty Evasion Investigation

The tariffs alone should have made imports prohibitively expensive. The coalition that pushed the original petition alleged that many importers kept bringing vehicles in without paying, and U.S. Customs and Border Protection opened a consolidated investigation under the Enforce and Protect Act. Evolution is one of the named targets.

The investigation, EAPA Consolidated Case 8247, was initiated in December 2025, with interim measures announced in April 2026.⁹ CBP said it had “reasonable suspicion” that Evolution and more than a dozen other importers were “unlawfully evading payment of significant antidumping duties and countervailing duties through various evasion and circumvention schemes.”¹⁰ Other named importers include ICON EV LLC, Denago EV Corporation, HDK Plastic Factory Ltd. (U.S.A.), Marxon Energy Inc., and Tao Motor Inc.¹¹ HDK Plastic Factory shares Evolution’s Corona principal address.¹²

The interim measures are aggressive. CBP is suspending liquidation of all unliquidated entries from the targeted importers. Entries made on or after December 30, 2025, are being rejected outright and must be refiled as subject to the full AD/CVD duty rates. Going forward, any shipments must be filed as “live entry” with the applicable duties, which for Evolution’s supplier could mean combined deposits above 350%.¹⁰

Court filings from a related case involving ICON EV, investigated under the same consolidated matter, describe the kind of schemes CBP suspects: breaking finished vehicles into separately shipped parts to argue they fell outside the AD/CVD orders, and routing goods through Vietnam to disguise their Chinese origin. Whether identical allegations apply to Evolution has not been publicly specified.¹³ ICON has already won a temporary restraining order and preliminary injunction from the U.S. Court of International Trade blocking CBP’s interim measures against it on Fifth Amendment due process grounds, a ruling that could influence how CBP handles Evolution’s file even though each company’s facts differ.¹⁴ CBP is expected to issue final evasion determinations near the end of 2026.

The California Air Resources Board Settlement

Separate from the trade cases, Evolution and HDK Plastic Factory settled an enforcement action with the California Air Resources Board in September 2024. The two companies agreed to pay $550,000 to resolve allegations that they had sold 1,645 new electric vehicles and golf carts in California without obtaining the required CARB Executive Orders, which are California’s own emissions approvals on top of federal standards.¹⁵ Half the penalty went to California’s Air Pollution Control Fund; the other half funded a marine vessel speed reduction project. Evolution and HDK admitted the underlying facts but denied legal liability.¹²

What This Means If You Own or Are Shopping for an Evolution Cart

As of mid-2026, Evolution still sells carts through a U.S. dealer network, listing 2026 models on its website with prices from about $6,795 for a basic four-seater to over $17,000 for larger utility configurations, and at least one Florida dealer lists the 2026 lineup as available to order.¹⁶¹⁷ But the combination of duties above 350% and an active CBP evasion probe creates the kind of cost pressure that industry analysts say could push some Chinese-origin brands out of the U.S. market altogether.¹⁸

For existing owners, the practical concern is whether replacement parts and warranty support hold up if import volumes drop or if CBP’s final determination goes against Evolution. The BBB complaint record already shows customers waiting months for parts and struggling to reach the company. For prospective buyers, the questions worth asking a dealer are direct: what is the warranty term, who performs warranty work locally, how long do parts orders currently take, and what happens to service commitments if the manufacturer’s imports are further restricted. None of the current cases has produced a recall or a court finding that Evolution vehicles are defective as a matter of law, but the volume and consistency of the service complaints, together with the pending federal action, are the material facts a buyer has to weigh.
