Bryten Real Estate Partners Lawsuits and BBB Complaints

Bryten Real Estate Partners, the Phoenix-based apartment manager formed in 2024, is a defendant in an active federal Fair Housing Act case in Florida and two other pending civil suits, and it has drawn dozens of Better Business Bureau complaints, most of which the company has not answered. The lawsuits and BBB complaints against Bryten Real Estate Partners are summarized below, with what the public record shows about the status of each.

The Company Behind the Cases

Bryten was created in April 2024 through the merger of MEB Management Services in Phoenix and Weller Management in St. Petersburg, Florida.¹ It manages roughly 47,000 units across 11 states.²

One structural detail matters for reading the litigation. The Bryten trademark is used by a network of separate private entities, and the company’s own site states that no parent, subsidiary, or affiliate has authority to bind another entity in the network.³ The predecessor firm, Morrison Ekre & Bart Management Services Inc. (commonly MEB), still exists and appears as a co-defendant alongside Bryten in at least one pending suit.⁴

Bens v. Bryten: Federal Fair Housing Act Case in Florida

The highest-profile suit is a federal civil rights case in the U.S. District Court for the Middle District of Florida. Marcelus Bens sued Bryten Real Estate Partners, LLC and the Collier County Housing Authority on July 11, 2025, alleging violations of the Fair Housing Act, 42 U.S.C. § 3601.⁵ The docket does not spell out the specific factual allegations.

The case has moved through several rounds of pleading. On October 17, 2025, Judge John E. Steele dismissed the Collier County Housing Authority entirely and granted in part and denied in part Bryten’s motion to dismiss, allowing Bens fourteen days to amend. The court dismissed the Third Amended Complaint on February 10, 2026, calling it a “shotgun pleading,” a term for a complaint that lumps claims together so imprecisely that it is impossible to tell which facts support which legal theory.⁵

Bens filed a Fourth Amended Complaint on February 23, 2026, and Bryten responded on March 3, 2026, with another motion to dismiss for failure to state a claim. The defendants also asked the court to declare Bens a vexatious litigant, but that motion was denied in February 2026 on procedural grounds for failure to confer before filing.⁵ The case remains active as of June 2026.

Johnston v. Bryten: Arizona Civil Case

Theresa Johnston filed a civil suit against Bryten Real Estate Partners LLC on August 21, 2024, in Maricopa County Superior Court. The other defendants are 1820 W Linder Ave Investors LLC, Asset Living LLC, and Morrison Ekre & Bart Management Services Inc. The docket classifies the matter broadly as civil and does not detail the allegations. An amended complaint was filed on September 4, 2024, and a pre-trial conference is scheduled for September 14, 2026, after two earlier settings were vacated.⁴

Brownlee v. Bryten: Florida Personal Injury Case

Deja Brownlee, acting as the natural parent and guardian of a minor identified as A.W., sued Bryten Real Estate Partners LLC along with 2148 54th Avenue LLC and an individual named Carmen Rodriguez, in the Sixth Judicial Circuit in Pinellas County, Florida. Summons was issued on February 23, 2025. Because the plaintiff is suing on behalf of a minor child, the claim appears to sound in personal injury or negligence, though the court records available do not detail the allegations. The case was listed as filed as of June 2026.⁶

Pre-Merger Case Against MEB

Bryten’s predecessor entity carried its own docket into the merger. Connie Colter sued Morrison Ekre & Bart Management Services and Alta Vista Village Apartments of Arizona LLC in Maricopa County Superior Court on May 23, 2023. The docket categorizes the case only as “other” civil litigation and does not detail the claims. It was listed as pending in the most recent available records.⁷

Better Business Bureau Complaints

Bryten is not BBB-accredited. The Phoenix headquarters profile lists 37 complaints filed over three years, with 20 closed in the most recent twelve months. Of those 37, one was marked resolved and 36 were listed as unanswered.⁸ A separate profile for the Florida office lists 12 more complaints, with 11 answered by the business but not resolved to the complainant’s satisfaction.⁹

The complaints fall into a few recurring categories:

Heating and HVAC failures. One tenant reported 32 days without heat in late 2025, and another described a nine-month stretch without a working heating system.⁹
Maintenance delays for broken sinks, dishwashers, and ceiling leaks, with tenants describing repeated follow-up calls and emails before any response.⁹
Billing and lease disputes, including allegations of late security-deposit returns, disputed final account statements, and restrictive lease-break policies.⁹
Pest problems, with some tenants reporting rodent and cockroach infestations that persisted after treatments.⁹

Where the company has responded on the BBB platform, it has generally stated that the concerns have been addressed and directed complainants to contact onsite staff.⁹ The lawsuits and most of the BBB complaints remain unresolved as of mid-2026.
